New non-fatal strangulation offences added to Family Violence Bench Book.

Our Family Violence Bench Book has been updated to include information on the new non-fatal strangulation offences, which come into effect on 13 October 2024.

These offences criminalise choking, strangling, or suffocating a family member, including a more serious offence where the offender intentionally causes injury.

Non-fatal strangulation is a severe offence with serious physical and psychological consequences. The act of applying pressure to the neck is dangerous, with the potential to cause death or serious injury, and often leaves victims feeling as though their lives are at risk.

This behaviour is common and is a strong indicator of escalating domestic violence. Research shows that women who survive non-fatal strangulation are over seven times more likely to be killed by their partner in the future.
